Title VI Nondiscrimination Policy Statement

It is the policy of CCT, as a federal-aid recipient, to ensure that no person shall, on the ground of race, color, national origin, sex, religion, age or disability, be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any of our programs and activities, as provided by Title VI of the Civil Rights Act of 1964, the Civil Rights Restoration Act of 1987, and all other related nondiscrimination laws and requirements.

Requests for Reasonable Modifications of Policies and Procedures


Clay County Transportation is committed to ensuring a reliable, accessible experience for all customers. If, due to a disability, you are not able to fully utilize Clay County Transportation programs and services (including ( demand response, subscription services) because of a policy or procedure that (Clay County Transportation) has established, you may submit a request for a modification of the policy or procedure. To request a modification, complete a Request for Modification of Policy/Procedure Form, which is available online at (www.claycountytransportation.com) or by calling (828-389-0644 or 1-800-735-2962 TTY or 1-800-735-8263 Voice). All requests for reasonable modifications to __(Clay County Transportation)__ policies or procedures will be considered on an individual basis. Please note that the __(Clay County Transportation)__ may be unable to accommodate requests for modifications which would: (1) result in a fundamental alteration to the nature of the service; (2) create a direct threat to the health or safety of others, and; (3) create an undue financial or administrative burden. Requests for modifications might also not be granted if __(Clay County Transportation)__ determines that the service can be fully utilized without the requested change. In the event that a barrier to access exists, but the requested modification cannot be granted, (Clay County Transportation) will, to the maximum extent possible, assist in determining other possible actions that might be taken to provide access to its programs and services.

What You Need to Know

  • Seatbelts must be worn at all times. This is NC State Law.
  • Passengers are not permitted to eat, drink or use tobacco products while on board the vehicles. Exceptions will be made only for medical reasons.
  • A 15 minute “service window” is allowed for passenger trips. This means that the vans may pick you up 15 minutes before or after your scheduled pick up time.
  • No disruptive or abusive behavior towards other passengers or the driver will be tolerated.
  • No weapons are allowed on Clay County Transportation vehicles.
  • Alcohol is not allowed onboard the vehicles.
  • No child under 8 years or 80 pounds will be transported unless the parent or guardian has provided and secured an age appropriate car seat.
  • We are a transportation service only; we cannot provide personal assistance such as dressing or lifting passengers out of bed or wheelchairs.

  1. Reasonable Modification of Policies and Procedures


Individuals with disabilities may ask __(Clay County Transportation)__ to modify a policy or procedure if they feel the policy or procedure is discriminatory or prevents them from fully utilizing __(Clay County Transportation)__ services. __(Clay County Transportation)__ will review these requests and will modify policies unless it finds that:

  • The person can fully utilize the service without the requested modification (i.e., it is for convenience only).

  • The change would create a direct threat to the safety of others.

  • The change would fundamentally alter the nature of the service.

  • The change would cause an undue financial or administrative burden.


(Clay County Transportation) encourages people to request such modifications in advance when possible. Clay County Transportationwill be guided by examples in Appendix E of 49 CFR Part 37 (http://www.ecfr.gov/cgi-bin/text-idx?c=ecfr&SID=d315855e2f2c9f940970f4c191349c12&rgn=div5&view=text&node=49:1.0.1.1.27&idno=49#ap49.1.37_1215.e) when making decisions on requests for modifications of policies. (Note: transit system should have these examples readily available for review).


If __Clay County Transportation__ denies a request, it will consider other reasonable actions or approaches that might be able to meet the person’s needs.


__Clay County Transportation__ has designated its _Director__ to coordinate the acceptance and review of requests for reasonable modifications of policies. This policy will be communicated to the public on the Clay County Transportation website and in the rider’s guide, system informational guide/brochure, etc.
